Federal Court Rules California Can Control Vehicle Emissions
Wednesday December 12, 2007
U.S. District Court Judge Anthony Ishii today handed down a landmark decision when he ruled that California has the right to regulate vehicle greenhouse gas emissions that contribute to global warming. In making his ruling, Judge Ishii rejected automakers' claims that federal law prevented the state from setting its own emissions regulations. He concluded that Congress never intended to interfere with a state's right to protect public health and welfare, and that no agency attempting to reduce greenhouse gases and curb global warming should be prevented from taking such action.
